    Awarables exhibits at the 10th Annual Health 2.0 Conference in Santa Clara

    Awarables was 1 of 11 companies invited to participate in the 2nd Sleep Technology Summit, part of the Health 2.0's 10th Annual Conference held in Santa Clara, CA Sept. 26-28. Sleep technologies included white noise machines to music playing pillows, as well as consumer products to measure sleep quality. One of the major discussion topics throughout the meeting was the "So what" question of data without targeted action. Most consumer devices provide data regarding an individual's sleep but fall short on providing actionable outcomes. Awarables' sleep improvement system was unique in presenting a comprehensive solution to monitor sleep quality and provide personalized insights for sleep improvement through guided behavior therapy.

    Awarables Receives $500,000 investment from Baltimore based Abell Foundation

    The Abell Foundation Inc. has invested $500,000 in Awarables Inc., a Baltimore-based medical device company that aims to improve people's quality of sleep through in-home testing and treatment.

    "Baltimore has long been known for cutting edge medical research and innovation," said Abell Foundation President Robert C. Embry Jr. "Companies like Awarables show it's possible to bring that research to the market, support job growth in the city, and potentially improve the quality of life for millions of people."

    Nearly 70 million Americans suffer from poor sleep, which can impact health and well-being. Thirty million Americans suffer from chronic insomnia and 18 million live with sleep apnea, a disorder which causes a person's breathing to start and stop during sleep. In search of remedies, Americans make about two million visits to sleep labs each year.

    Awarables provides devices, data analysis and testing services to doctors to understand patients' sleep behaviors over the course of multiple nights of sleep in their own homes. Through heart rate sensors, motion sensors, snore microphones, and light and temperature sensors, the company's technology offers a comprehensive image of a person's sleep experience.

    Often, individuals diagnosed with sleep apnea are fitted with a breathing device to keep the airway open, but if that fails, the next step is frequently surgery. Those living with insomnia have even fewer options, and often are prescribed sleep aids that can interfere with the normal sleep cycle and promote long-term dependence on medication.

    Awarables also has an exclusive license for a diagnostic tool for sleep apnea called SONOSA that was created by Dr. Jeffrey Wolf and Dr. Amal Isaiah at the University of Maryland Medical Center. SONOSA allows physicians to see a 3-D ultrasound image of the impaired airway to improve treatment options and outcomes. Embry said Awarables appealed to Abell because it is a company trying to "address widespread with an exciting approach." Abell is the lead investor in Awarables and helped secure the company's decision to move to Baltimore. The two-year-old company is primarily based in Bethesda and opened an office on Pratt Street a few months ago.

    Awarables receives grant from NEPDC for development of sleep monitoring device

    The New England Pediatric Device Consortium (NEPDC) is a non-profit foundation supported by the FDA’s Office of Orphan Products Development (OOPD) to promote commercialization of safe and effective technologies for pediatric clinical care. NEPDC accelerates commercialization by connecting innovators with an extensive network of clinicians, researchers, technologists, and business development specialists located at institutions throughout New England. Through our Seed Award program, NEPDC evaluates product concepts across the commercialization spectrum, from ideas to near-to-market devices, and provides rapid and targeted assistance to innovators seeking to address the needs of children suffering from disease or disabilities.

    November 19, 2013 - Awarables team was accepted and completed the National Science Foundation sponsored DC I-Corps Entrepreneurship program from October 7 – November 19, 2013. During this six-week program, we applied the Lean Startup principles to our startup, testing our product-market fit, and adapting a viable business model for our innovation.
    DC I-Corps is a regional program designed to foster, grow and nurture an innovation ecosystem. The program is sponsored by the National Science Foundation (NSF) and jointly run by the University of Maryland College Park, George Washington University, and Virginia Tech.     National Science Foundation SBIR Grant

    Our technology brings together hardware + software components for sleep monitoring and sleep improvement. The device is a multi-sensor, small, wearable device that collects physiological data (i.e. heart rate) and sleep environment data. It is meant to be used for multiple nights to capture the variations in sleep patterns and gather a comprehensive picture of the person's sleep health. We have patent-pending algorithms for sleep staging and visualization of an individual's entire night of sleep (personal "sleep architecture"). Our mobile software component captures user sleep habits/daytime performance/mood along with giving personalized therapy for improving their sleep health (using cognitive behavior therapy).  Our system can be used at home, for multiple nights, for chronic sleep problems, personal sleep therapy, and therapy adherence (when working with a healthcare provider).

    Sleep Analytics System for ADHD/ASD Pediatrics

    National Science Foundation

    Among the 5.2 million children with ADHD some 25%-50% suffer from poor sleep. Similarly, children with Autism Spectrum Disorder (ASD) experience poor sleep at a much higher rate (40%-80%). Awarables is customizing its Sleep Analytics System to enable parents to monitor, assess and understand the nature of their child’s sleep problems in the context of their overall health.

    The Performance Triad defined by the US Army Surgeon General lists Sleep along with Activity and Nutrition (ANS) as the key components to improve the readiness and resiliency of US Army Personnel. END USER LICENSE AGREEMENT
END USER LICENSE AGREEMENT (the “Agreement”) between Awarables Inc., a corporation having its headquarters at 300 West Pratt St., Suite 200, Baltimore, MD 21201 (“we” or “Awarables”) and the end user who accepts the terms in this agreement or otherwise accesses or makes use of the Services and/or Software (“you” or the “User”).
PLEASE READ THIS AGREEMENT CAREFULLY. THIS AGREEMENT IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND AWARABLES AND THIS AGREEMENT SHALL GOVERN YOUR ACCESS AND USE OF AWARABLES’ CUSTOMIZED MACHINE READABLE CODE-BASED SERVICES (THE “SERVICES”) THROUGH YOUR INSTALLATION OF THE EXECUTABLE SOFTWARE PROVIDED BY AWARABLES VIA ITS APPLICATION KNOWN AS AWARABLES SLEEPBETTER APP (THE "LICENSED SOFTWARE") ON YOUR COMPUTER HARDWARE AND YOUR USE OF SUCH SOFTWARE IN CONNECTION WITH HARDWARE, IF ANY, PROVIDED BY AWARABLES, AS WELL AS ANY MANUALS, INSTRUCTIONS, DESCRIPTIONS, SPECIFICATIONS OR OTHER MATERIALS, IN HARD COPY OR ELECTRONIC FORM, PROVIDED BY AWARABLES DESCRIBING OR RELATING TO THE USE OF THE SERVICES (THE "DOCUMENTATION"), ABSENT ANOTHER SIGNED LICENSE AGREEMENT COVERING THE SERVICES/SOFTWARE EFFECTIVE BETWEEN YOU AND AWARABLES. TO THE EXTENT THIS AGREEMENT IS CONSIDERED TO BE AN OFFER BY AWARABLES, YOUR ACCEPTANCE IS EXPRESSLY LIMITED TO THE TERMS AND CONDITIONS SET FORTH HEREIN. ANY TERMS IN ANY PURCHASE ORDER OR OTHER DOCUMENTATION ISSUED BY OR ON BEHALF OF YOU THAT CONTAINS ADDITIONAL OR CONFLICTING TERMS OR PURPORTS TO REPLACE, REJECT, MODIFY OR BE A COUNTER OFFER TO THIS AGREEMENT ARE EXPRESSLY REJECTED AND ARE VOID.

BY CLICKING THE "I ACCEPT" BUTTON OR BY DOWNLOADING, INSTALLING, USING OR OTHERWISE ACCESSING THE SERVICES, YOU INDICATE THAT YOU INTEND YOUR ACT TO SERVE AS YOUR SIGNATURE TO THIS AGREEMENT AND TO HAVE THE SAME FORCE AND EFFECT AS THE USE OF A MANUAL SIGNATURE, AND IF YOU ARE INSTALLING, USING OR OTHERWISE ACCESSING THE SERVICES IN YOUR CAPACITY AS AN EMPLOYEE OR AGENT OF A BUSINESS ENTITY, YOU WARRANT THAT YOU HAVE ACTUAL AUTHORITY TO LEGALLY BIND SUCH ENTITY TO THIS AGREEMENT. 


1. The Licensed Software is owned by Awarables The Licensed Software is licensed, not sold, only on the terms of this EULA. By using the Licensed Software, you represent and warrant that (a) you are 17 years of age or older and you agree to be bound by this Agreement; (b) if you are under 17 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the Licensed Software does not violate any applicable law or regulation. Your access to the Licensed Software may be terminated without warning if Awarables believes, in its sole discretion, that you are under the age of 17 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child's use of the Awarables App, you agree to be bound by this Agreement in respect to your child's use of the Licensed Software. 
2. Upon installation of the Licensed Software, you will acquire the limited right to use the Licensed Software, directly from Awarables. You assume responsibility for the selection of the program to achieve your intended results, and for the installation, use and results obtained from the Licensed Software.
3. Awarables and you acknowledge that this Agreement is concluded between Awarables and you only, and not with any other person or entity, including, without limitation, Apple, Inc. Awarables is solely responsible for the Licensed Software and its content. Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. 
4. In consideration of your acceptance of the terms and conditions contained in this EULA, Awarables grants you a non-exclusive license to use the Licensed Software and the associated documentation for your own needs on one device. You are not licensed to rent, lease, transfer, or distribute the Licensed Software. ALL RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED BY AWARABLES.
5. Title to the Licensed Software, including media and documentation, remain with Awarables. You may not copy, reproduce or make data transmissions, in whole or in part, except as is necessary for back-up or archival purposes. You may not reverse engineer, translate, disassemble, decompile or otherwise attempt to discover the source code of the Licensed Software or create similar software in whole or in part.
6. The license is effective upon your acceptance and installation of the Licensed Software and shall continue until terminated. You may terminate it at any time by uninstalling the Licensed Software. Awarables has the right to terminate this Agreement WITHOUT NOTICE if you fail to comply with any term or condition of this EULA. Upon termination you shall stop all use of the Software and uninstall the Licensed Software.
7. "Confidential Information" means any and all of Awarables’ confidential or proprietary technical or business information, in any tangible or non-tangible form. User acknowledges that the Services, the Licensed Software and the Documentation constitute valuable trade secrets of Awarables and that the Services, the Licensed Software and the Documentation are included in the Confidential Information of Awarables. User agrees that it shall (i) not use any of the Confidential Information except to achieve the purposes of this Agreement; (ii) not provide access to or disclose any Confidential Information to any third party; and (iii) take actions to protect the confidentiality of all Confidential Information which are at least as stringent as the precautions it takes to protect its own confidential information and which in all cases are at least reasonable precautions. Confidential Information received by Awarables from a third party will be deemed Confidential Information of Awarables. You expressly acknowledge and agree that any misuse or disclosure of Confidential Information would cause irreparable harm and, without limiting any of Awarables’ other remedies at law or equity, in the event of any actual or threatened breach or violation of the provisions of this Agreement concerning Confidential Information, Awarables is entitled, without limiting any of Awarables’ other remedies at law or equity, to obtain injunctive relief (temporary and permanent) from any court of competent jurisdiction immediately upon request and without the need to post a bond or security, with respect to any such breach or potential breach in addition to any other remedies. Confidentiality obligations pertaining to the Licensed Software will survive any termination of this EULA, to include the application, design, and functionality.
8. THIS LICENSED SOFTWARE IS DISTRIBUTED AS IS, WHERE IS AND AS-AVAILABLE, BUT WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND OR NATURE WHATSOEVER; WITHOUT EVEN THE EXPRESS, IMPLIED, STATUTORY OR OTHER WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR AGAINST INTELLECTUAL PROPERTY INFRINGEMENT OR MISAPPROPRIATION.
9. To the extent allowed by applicable law, in no event will Awarables or any Awarables affiliate be liable to user or any third party for any damages of any kind or nature whatsoever, including, but not limited to, loss of data, loss of use, or indirect, special, incidental or consequential damages in any way related to or arising out of the use of the Licensed Software, whether based upon warranty, contract, or otherwise, whether or not injury was sustained by persons or property or otherwise, and whether or not loss was sustained from, or arose out of, use of Licensed Software. 
10. YOU UNDERSTAND THAT YOU ARE PERSONALLY RESPONSIBLE FOR THE USE OF AND ACCESS TO ALL DATA AND THE SERVICES, THE LICENSED SOFTWARE AND THE DOCUMENTATION BY YOU, ANY PERSON TO WHOM YOU HAVE GIVEN ACCESS TO YOUR DATA, THE SERVICES, THE SOFTWARE OR THE DOCUMENTATION, AND ANY PERSON WHO GAINS ACCESS TO ANY DATA, THE SERVICES, THE SOFTWARE OR THE DOCUMENTATION AS A RESULT OF YOUR FAILURE TO USE REASONABLE SECURITY PRECAUTIONS, EVEN IF SUCH USE OR ACCESS WAS NOT AUTHORIZED BY YOU, AS WELL AS ANY AND ALL RESULTS OF ANY SUCH USE OR ACCESS. YOU AGREE TO WAIVE ANY AND ALL CLAIMS AGAINST AWARABLES, ITS CONTRACTORS, SUBCONTRACTORS, AND SHALL INDEMNIFY AND HOLD HARMLESS AWARABLES, ITS CONTRACTORS, AND THEIR SUBCONTRACTORS FOR ANY DAMAGE THAT YOU MAY INCUR FROM YOUR USE OF THE LICENSED SOFTWARE.
11. Intellectual Property: You acknowledge that all intellectual property and other proprietary rights in and to the Licensed Software, the Documentation and the Services anywhere in the world belong to Awarables, that rights in the App are licensed (not sold) to you, and that you have no rights in, or to, the App, the Documents or the Technology other than the right to use each of them in accordance with the terms of this EULA. You acknowledge that you have no right to receive, discover, attempt to discover, use or examine any source code or design documentation relating to the Licensed Software or the Services. 
12. Limitation of liability: You acknowledge that the App has not been developed to meet your individual requirements, and that it is therefore your responsibility to ensure that the facilities and functions of the App as described in the Documents meet your requirements. We only supply the App and Documents for domestic and private use. You agree not to use the App and Documents for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS AWARABLES, AND EACH OF ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, RESELLERS, LICENSORS, SUPPLIERS, INVENTORS, OWNERS ASSIGNS OR AFFILIATES (EACH, AN “AWARABLES AFFILIATE”), FROM AND AGAINST ANY AND ALL LIABILITIES, LOSSES, DAMAGES (INCLUDING ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES), CAUSES OF ACTION, CLAIMS, SETTLEMENT PAYMENTS, INTEREST, ACTIONS, SUITS, AWARDS, JUDGMENTS, DIMINUTION IN VALUE, FINES, FEES OR PENALTIES, AS WELL AS ANY OTHER CHARGES, COSTS OR EXPENSES (INCLUDING, BUT NOT LIMITED TO, ANY COURT FILING FEE, COURT COST, ARBITRATION FEE, ARBITRATION COST, WITNESS FEE, AS WELL AS ANY OTHER FEE OR COST OF INVESTIGATING, DEFENDING OR OTHERWISE ASSERTING ANY CLAIM FOR INDEMNIFICATION UNDER THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, IN EACH CASE, ANY ATTORNEYS' FEES, OTHER PROFESSIONALS' FEES OR DISBURSEMENTS) (COLLECTIVELY, "LOSS") , IN ANY WAY ARISING FROM OR RELATED TO ANY SUCH USE OR ACCESS. IN NO EVENT SHALL AWARABLES HAVE ANY LIABILITY TO YOU OR ANY THIRD PARTY IN ANY WAY ARISING FROM OR RELATED TO ANY USE OF OR ACCESS TO ANY DATA, THE SERVICES, THE SOFTWARE OR THE DOCUMENTATION.

You acknowledge and agree that the Licensed Software is a personalized self-help system designed to help you improve your own sleep and that if you choose to access the Licensed Software you are solely responsible for identifying the suggested techniques to put into practice and to apply those techniques. You also acknowledge and agree that the Licensed Software is not intended to diagnose, treat or otherwise address any medical problem and any information available by implementing the Licensed Software, whether posted by Awarables employees, or other users, is provided for your information and not as medical advice and should not be seen as a replacement for consultation with a doctor or other qualified healthcare professional. If you receive advice from a doctor or other qualified medical professional which conflicts with anything received by implementing the Licensed Software, then the former should take precedence. You are urged and advised to seek the advice of a doctor before beginning any sleep improvement program. If you are concerned about your sleep problem, or if you frequently struggle to stay awake during the day, or if you are pregnant, or if you fall asleep during the daytime without intending to, or if you have any other concerns or questions about your health or medicines, you should always consult an appropriate healthcare professional. Be cautious in making any changes to your sleep pattern if you have any serious mental health condition including (but not limited to) depression, bipolar disorder or schizophrenia. Likewise, be cautious about embarking on vigorous exercise if you have any serious medical condition, including (but not limited to) back pain, high blood pressure or heart disease, or if you are pregnant. If you feel excessively sleepy during the day for any reason do not take risks in driving or operating machinery or other equipment. Always seek professional medical advice when contemplating any changes in your prescribed medicines.


13. You expressly understand and acknowledge that Awarables has the absolute right to obtain injunctive relief (temporary and permanent) from any court of competent jurisdiction immediately upon request and without the need to post a bond or security to protect Awarables’ proprietary rights.
14. By using the Licensed Software, you further agree that this is the complete and exclusive statement of the Agreement which supersedes any proposal or prior agreement, oral or written, and any other communications relating to the subject matter of this EULA.
15. If any provision of this Agreement is held to be invalid or unenforceable the remaining provisions will not be affected.
16. Objectionable Content Policy: Content may not be submitted to Awarables SleepBetter App. Awarables will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker.

17. Privacy notice: Awarables may collect and use information about your usage of the Licensed Software, including certain types of information from and about your device. Awarables may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Awarables App. Please refer to our detailed privacy policy at:  www.awarables.com/privacy
18. Awarables does provide minimal maintenance or support for the Licensed Software but not to the extent that any maintenance or support is required by applicable law, Awarables, not Apple, shall be obligated to furnish any such maintenance or support.
19. Awarables, not Apple, is responsible for addressing any claims by you relating to the Licensed Software or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Licensed Software fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.
20. Disclaimer: The content of this application is intended for use only as an informative tool.  It is not, is not intended to be, and should not be used in any way as a substitute for professional medical advice or training.  The accuracy of the information provided is not guaranteed.  You acknowledge in initiating this application that the information is not meant to diagnose a health condition or disease and is not meant to develop a health treatment plan.  If you are in an emergency or life-threatening medical situation, seek medical assistance immediately.  Dial emergency number (911 in the USA) for emergency medical services.
21.  Miscellaneous. This Agreement may be amended only by a writing executed by both parties unless modified from time to time by Awarables and posted on the Site. The next time YOU use the Licensed Software after such an update, YOU may be prompted to agree to or decline an update of this Agreement. YOU must agree to all revisions if YOU choose to continue using the Licensed Software. By using the Licensed Software, YOU agree to the then-current version of this Agreement as posted on the Site. If at any point YOU do not agree to any portion of the then-current version of this Agreement, YOU must immediately stop using the Licensed Software and uninstall the Licensed Software. This Agreement shall be governed by, and will be construed under, the laws of the United States of America and the laws of the State of Maryland, without regard to choice of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. 
All disputes arising out of or related to YOUR use of the Licensed Software, Service and/or Service Data shall be subject to the exclusive jurisdiction of the state and federal courts located within Maryland, and YOU agree to submit to the personal jurisdiction and venue of such courts. This Agreement constitutes the entire, final and integrated agreement between the parties concerning the subject matter hereof and supersedes all prior and contemporaneous understandings and communications, whether oral or written, between the parties relating to the subject matter hereof. Awarables reserves any rights or licenses other than those specifically granted herein. This Agreement shall not be assigned (by operation of law or otherwise) or transferred in any manner by YOU without the prior written consent of Awarables and any attempted assignment without Awarables’ consent shall be null and void. YOU will comply fully with all relevant export laws and regulations of the United States, including, without limitation, the U.S. Export Administration Regulations (collectively “Export Controls”). Without limiting the generality of the foregoing, YOU will not, and YOU will require YOUR representatives not to, export, direct or transfer the Licensed Software, or any direct product thereof, to any destination, person or entity restricted or prohibited by the Export Controls. If YOU are, or are entering into this Agreement on behalf of, any agency or instrumentality of the United States Government, the Licensed Software is “commercial computer software” and “commercial computer software documentation,” and pursuant to FAR 12.212 or DFARS 227.7202, and their successors, as applicable, use, reproduction, and disclosure of the Licensed Software are governed by the terms of this Agreement. YOU acknowledge that a breach of this Agreement would cause irreparable injury to Awarables for which monetary damages are not an adequate remedy. Accordingly, We shall be entitled to seek injunctive relief and other equitable remedies in the event of such breach.

Awarables Privacy Policy

Awarables is committed to protecting and respecting your privacy. This Privacy Policy (“Policy”) (together with Terms and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us and how you can get access to this information. The governing law for this Policy is that of the state of Maryland, United States.

1. Purpose of this Policy
Awarables provides you (the “User”) with access to the online and mobile services associated with the Awarables SleepBetter™ platform, including but not limited to our website (currently located at www.awarables.com) and all associated subdomains (the “Website”), and the Awarables mobile application (the “App”), collectively the “System”.

We may collect and process information provided by you through filling in forms on the System, including information provided during completion of surveys, sleep diaries and other online tools, posting of comments in the Community or requesting further services, information provided when purchasing a product or paying for access to restricted content, entering a competition or promotion and when you report a problem with our System. If you contact us, we may also keep a record of that correspondence.

Throughout your use of the System we may collect and process information, such as: personal information (name, date of birth, email address, etc.), pre-existing medical conditions, lifestyle, environment, medication, other health profile information and details of your visits to the System and the resources that you access (including, but not limited to, traffic data, location data, weblogs and other communication data), whether this is required for our own billing purposes or otherwise.

We are required by law to maintain the privacy of the information described in this Policy and to provide you with this notice of our legal duties and privacy practices with respect to it. When we use or disclose this information, we comply with law (including Health Insurance Portability and Accountability Act (“HIPAA”), if applicable) and the terms of this Policy (or other Policy in effect at the time of the use or disclosure). For simplicity and the good of our users, we aim to treat all identifiable health information with the same protections, whether HIPAA is applicable or not, and have used the HIPAA requirements as a guide in developing our data privacy and security protections. We use the blanket term ‘Identifiable Health Information’ in this Policy to refer to all identifiable health data (inclusive of Patient Health Information PHI).

Data that has been aggregated or stripped of identifiers outlined in HIPAA will no longer constitute Identifiable Health Information for the purposes of this Policy and we will be free to use it, alone or in combination with other information, without restriction in connection with providing services or otherwise.

IP addresses and cookies
We may collect information about your device, including where available your IP address, operating system, browser type and screen size. We may use this, among other things, to provide you with customer support, for system administration, to tailor your experience of the System, to report aggregate information internally, and for research, or as described in ‘How we use your information’.

For the same reason, we may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your device. Cookies help us to give you a smooth user experience, improve the System and deliver a better and more personalized service. They enable us:
•	To recognize you when you return to our system;
•	To maintain data you have entered e.g. during completion of a survey;
•	To speed up your searches;
•	To estimate our audience size and usage pattern; and
•	To store information about your preferences, and so allow us to customize the System according to your individual interests.

Both Awarables and third-party vendors, including Google and Apple, may use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on your past visits to the System on sites across the Internet (also known as 'remarketing'). If you would like to opt out of this you can do so via your Google Ads Preferences Manager.

You may refuse to accept cookies by changing the settings on your device to prevent cookies from being set. However, if you select this setting you may be unable to access certain parts of the System. Unless you have adjusted your browser setting so that it will refuse cookies, our system may issue cookies when you visit the System.

Please note that when a third party advertises on the System they too may also use cookies. Unfortunately we have no control over these cookies.

2. How we use your information
Awarables understands that your Identifiable Health Information is private and personal, and is dedicated to maintaining its confidentiality and integrity. As such, we will never sell or rent it and have policies and procedures and other safeguards to help protect it from improper use and disclosure.

“We follow a policy that minimizes any required disclosure of your identifiable health information”. The following categories describe the ways in which we use your Identifiable Health Information and the rare instances that require us to disclose it to persons and entities outside of Awarables. We have not listed every use or disclosure within the categories below, but all permitted uses and disclosures will fall within one of the following categories. In addition, there are some uses and disclosures that may require your specific authorization.

How much Identifiable Health Information is used or disclosed without your written permission will vary depending, for example, on the intended purpose of the use or disclosure, and appropriate laws.  For example:
•	Disclosure at your request: We may disclose information relating to your use of the System when requested by you. This disclosure at your request may require written authorization by you.
•	Payment: We do not store credit card details or customer details with any 3rd parties except trusted suppliers who help us deliver the services associated with the System and we are committed to ensuring that all suppliers meet our security and data protection standards. As such, we may use and disclose your Identifiable Health Information to obtain payment for services that we provide to you. 
•	Services and Operations: We may use and disclose your Identifiable Health Information in connection with providing services, for our internal operations, which include administration, eligibility, planning, analytics and various activities that assess and improve the quality and cost effectiveness of the service that we deliver to you. Examples are using information about you to improve quality of the service, satisfaction surveys, de-identifying health information, customer services and internal training. 
•	Emails: We may receive a confirmation when you open an email from us, or click on a link in an email, if your computer supports this type of program. We use this confirmation to help us make emails more interesting and helpful. When you receive an email from us, you can opt out of receiving further emails by following the included instructions to unsubscribe. However, by opting out of further email communications after you sign up, you may limit program reminders and other valuable program content and components.
•	Reminders and notifications: We may use and disclose your Identifiable Health Information to contact you as a reminder to interact with, or complete tasks relating to your use of the System.
•	Third party service providers: There are some services provided in our organization through third party services providers. Examples of third party services providers include accounting services, server hosting and email delivery providers, business associates, vendors and other business partners and reputable companies in the industry who subcontract to us as our corporate customers, where permitted by law. We may disclose your Identifiable Health Information to our third party services providers so that they can perform the job that is required of them. To protect your Identifiable Health Information, we require appropriate contracts or written agreements be in place that safeguard your Identifiable Health Information
•	Third party medical professionals: With your permission, we may share your Identifiable Health Information with third party medical professionals nominated by you. You can revoke your permission at any time via your account page.
•	Public access to Community posts: Most of the Awarables Community isn’t publicly accessible and is only visible to other logged-in members. However, there is a subset of ‘General Chat’ discussions which may appear in public searches. The profile messages appearing on the Community homepage at any one time may also be visible to non-members. While we’ve taken care to anonymize your username in such cases (as “Awarables member”), we’re not able to change the content of your comment or message. For this reason we recommend that you exclude identifying information if you would like to remain anonymous while using the Community. You may also want to choose a username that is unique to your Awarables account and which wouldn’t likely identify you in any other context.
•	Threat to health or safety: We may use and disclose your Identifiable Health Information when necessary to prevent a serious threat to your health and safety or the health and safety of the public or another person. Any disclosure, however, would only be to someone able to help prevent the threat.
•	As required by law: Certain laws permit or require certain uses and disclosures of Identifiable Health Information for example, for public health activities, health oversight activities and law enforcement. In these instances, Awarables will only use or disclose your Identifiable Health Information to the extent the law requires.
•	Personal representatives or persons involved with your care: We must use and disclose your Identifiable Health Information to anyone who has the legal right to act for you (your personal representative) in order to administer your rights. We may also use or disclose your Identifiable Health Information to a person involved in your care or who helps pay for your care, such as a family member, when you are incapacitated or in an emergency, or when you agree or fail to object when given the opportunity. If you are unavailable or unable to object, we will use our best judgment to decide if the disclosure is in your best interests. Special rules apply regarding when we may disclose health information to family members and others involved in a deceased individual's care. We may disclose health information to any persons involved, prior to the death, in the care or payment for care of a deceased individual, unless we are aware that doing so would be inconsistent with a preference previously expressed by the deceased.
•	For research and publicity purposes: We may use Identifiable Health Information for internal and external research and publicity purposes. This may include publishing aggregate information about our users (for example, that 1 in 3 women aged 30-40 struggle with chronic insomnia in the US) in the context of providing public health information and conducting academic research. In certain instances, we may only provide such information with special waivers and permissions from you.
•	Transfer of business assets: In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets. If Awarables or substantially all of its assets are acquired by a third party, personal data held by it about its customers will be one of the transferred assets.

3. Where we store your personal data
Information you provide to us is stored in encrypted form on secure servers located in the US, which are owned and operated by industry leading providers of such data storage services. All passwords are stored in encrypted form and all sensitive traffic is transmitted securely via SSL by default.

Your data may be transferred to or stored at or both other destinations inside Awarables by or to staff who work for Awarables or one of our suppliers. Such staff may be engaged in, among other things the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing.

Unfortunately, despite these measures, the transmission of information via the internet (especially by email) is never completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of any of your data transmitted to the System, or transmitted from the System to you, and any transmission is at your own risk. Once we have received your information, we will use strict procedures to try to prevent unauthorized access in accordance with our Company data protection policy and code of practice, and appropriate laws.

4. Your rights regarding your Identifiable Health Information
You have certain rights with respect to your Identifiable Health Information. 

•	Restrictions: You have the right to request in writing that we do not disclose certain information about you. We do not have to agree to any restriction that you request. To request a restriction, please contact the Privacy and Security Officer whose contact information is below.
•	Confidential Communications: You have the right to request in writing that we restrict the way in which we communicate information regarding your health and health care services, such as ceasing to send email or SMS messages to notify or remind you about aspects of the System or your progress through the Awarables SleepBetter™ program. We will make reasonable efforts to accommodate your request, or to provide alternative means of communication where possible.
•	Access: You have the right to inspect and copy most of your Identifiable Health Information maintained by us. Normally, we will provide you with access within 30 days of your request. We may charge a reasonable fee for doing this.
•	Amendment: You have the right to request that we amend your written Identifiable Health Information. For instance, you can request that we correct an incorrect date of birth in your records. We will generally amend your information within 60 days of your request, and will notify you when we have amended your information. We can deny your request in certain circumstances, such as when we believe that your information is accurate and complete. We cannot take responsibility for actions based on information incorrectly provided by you, such as emails sent to incorrect addresses.
•	Accounting: You have the right to request an accounting from us of certain disclosures made by us. We will generally provide you with your accounting within 60 days of your request. In addition, we will notify you as required by law if there has been a breach of the security of your Identifiable Health Information.

6. Amending this Policy
We reserve the right to revise this Policy without notification and to make the revised Policy effective for all data that we created or received prior to the effective date of the revised Policy. Any changes or updates will be effective immediately upon posting to www.awarables.com/privacy. Your continued use of the System constitutes your agreement to abide by the Privacy Policy as changed. Under certain circumstances (for example, if we expand the ways in which we use your personal information beyond the uses stated in our Privacy Policy at the time of collection), we may also elect to notify you of changes or updates to our Privacy Policy by additional means, such as by sending you an email. 

Questions relating to revisions to this Policy may be addressed to the Privacy and Security Officer whose contact information is below. This Policy will be promptly revised if there is a material change to a policy described herein.

Concerns or Complaints
If you believe that any of your rights with respect to your or others’ Identifiable Health Information have been violated by us, our employees or agents, please communicate with the Awarables Privacy and Security Officer at:

If we are subject to HIPAA, you may also contact the Secretary of the U.S. Department of Health and Human Services. Under no circumstances will we take any retaliation against you for filing a complaint.
